On today’s episode of The Josh Lafazan Show, we examine one of the most explosive and under-discussed legal stories of the year: Donald Trump and his administration are now openly defying a 9-0 Supreme Court ruling — yes, unanimous — and we’re asking the question every American should be: are we now in a full-blown constitutional crisis?
The case at the center of this firestorm involves Abrego Garcia, a Maryland man deported by the Trump administration to El Salvador after being accused of MS-13 gang affiliation — despite the fact that he was never convicted of any gang-related crimes. The deportation sent Garcia to a supermax prison in El Salvador, and the Supreme Court has now ruled 9-0 that the U.S. government must facilitate his return. Yet Trump has made it abundantly clear: he has zero interest in bringing him back. And his Department of Justice is now arguing that they don’t have the ability to comply — that only El Salvador can bring him back.
But let’s be real: Trump and El Salvador’s President Nayib Bukele have an extremely cozy relationship, and Bukele was literally just at the White House. If Trump wanted Garcia returned to the U.S., he would be. This isn’t a logistical issue — it’s a willful decision to ignore the highest court in the land. And that puts us in unprecedented and extremely dangerous legal territory.
This episode isn’t about defending Abrego Garcia or taking a soft stance on immigration — and I say that as a Democrat who has been consistently tough on border security. I’ve called out Biden for failing to secure the border and have applauded Trump in the past for bringing border crossings down to near zero. This isn’t about immigration. It’s about the rule of law. And when the executive branch can ignore a direct order from the Supreme Court — and do so openly and proudly — we are watching the foundations of our democracy start to shake.
Democratic lawmakers are taking action. Representative Ritchie Torres (D-NY) has introduced the RESCUE Act, which would require the United States to suspend diplomatic relations, foreign aid, bilateral agreements, and visas for government officials of any country that refuses to comply with a U.S. court order involving wrongfully deported individuals. I strongly support this legislation. If we’re going to claim to be a nation of laws, that has to mean something — even when it’s inconvenient.
Some Democrats are also beginning to float articles of impeachment — and if you’re keeping score, yes, that would be Trump’s third. And if he wins in November, this could be a battle the next Congress is forced to reckon with. Because if a President can deport people unilaterally and then ignore court orders to reverse those deportations — what can’t he do?
But just as much blame lies with the Supreme Court itself — specifically, Chief Justice John Roberts. Let’s not forget that just last year, SCOTUS granted Trump presidential immunity for all “official acts” taken in office. So, if ignoring the Supreme Court is now framed as an “official act,” we’ve created a legal loophole wide enough to drive authoritarianism through. Even in this 9-0 ruling, Roberts’ language was vague, deferential, and toothless — when it should’ve been a swift, unmistakable rebuke of executive overreach.
And yet, most of the mainstream media isn’t treating this as a constitutional crisis. Instead, they’ve flattened the issue into a tired left-vs-right debate about immigration. But it’s not about open borders vs closed borders. It’s not about Democrats vs Republicans. Most Americans — like me — want tough border security and a government that abides by the Constitution. Why is that so hard for legacy media to grasp?
The truth is, our institutions are failing in multiple directions. The courts refuse to assert their authority. The executive branch is acting like it's above the law. The media is chasing ratings instead of doing real journalism. And the American people — especially younger generations — are growing dangerously disillusioned with our system altogether. That’s why this show exists. To rise above the noise, and call it like it is.
So let me be clear: if you care about the Constitution, this case should terrify you. If a President can ignore the judiciary without consequences, then we’ve crossed a line that endangers our democracy. And if Democrats take back the House in 2026, they have a duty to bring forward articles of impeachment and hold this administration accountable.
